UnityMix Terms of Use

1. Definitions

• "UnityMix," "we," "us," or "our" means UnityMix, Inc., together with its applicable affiliates, subsidiaries, services, websites, applications, systems, and authorized service providers.
• "User," "you," or "your" means any person or entity accessing or using UnityMix.
• "Creator" means a User who creates, publishes, streams, sells, distributes, or monetizes permitted content, products, services, or experiences through UnityMix.
• "User Content" means text, photographs, images, videos, audio, livestreams, messages, comments, files, profiles, posts, or other materials submitted, uploaded, transmitted, streamed, or otherwise made available through UnityMix.
• "Services" means the UnityMix website, applications, APIs, platform, creator tools, messaging, subscriptions, marketplace, livestreaming, audio/video communication, monetization systems, and related services.
• "Paid Content" means content, messages, media, subscriptions, services, communications, or other materials made available for payment.
• "Subscription" means a recurring or fixed-term paid membership, Creator subscription, or similar paid access arrangement.
• "Face Liveness + Adult Age Check" means a security and age-assurance process that helps determine whether a real person is present and may subsequently perform an approximate estimation of whether the person appears to be 18 or older. It does not determine a person's exact age, legal identity, or date of birth.

2. Acceptance of These Terms

These Terms of Use constitute a legally binding agreement between you and UnityMix, Inc. concerning your access to and use of the Services.

By creating an account, accessing the Services, browsing permitted areas, posting content, communicating with other Users, purchasing a subscription, becoming a Creator, using monetization features, or otherwise using UnityMix, you agree to these Terms and all policies incorporated into them.

If you do not agree to these Terms, you must not access or use UnityMix.

3. Eligibility & Minimum Age

UnityMix is strictly an 18+ platform.

You must be at least 18 years old, or satisfy any higher applicable age requirement imposed by the law governing your access to the Services.

Individuals who do not satisfy the applicable minimum-age requirement are prohibited from accessing or using UnityMix.

• Creating an account.
• Browsing or accessing UnityMix content.
• Viewing public or private profiles.
• Communicating with Users or Creators.
• Purchasing subscriptions or Paid Content.
• Participating in livestreams.
• Using messaging, calls, or other communication features.
• Using marketplace or monetization features.
• Creating or operating a Creator account.

4. Age Representation & Truthful Information

You represent and warrant that all age and date-of-birth information you provide to UnityMix is accurate, truthful, current, and not misleading.

You must not falsely represent that you are 18 years old or older. You must not alter, manipulate, conceal, or falsify information for the purpose of circumventing UnityMix's age requirements.

You must not use another person's account, identity, verification information, identification documents, or other credentials to circumvent an eligibility restriction.

5. Age Assurance & Verification

UnityMix may use reasonable age-assurance and security measures to support its adults-only access model.

These measures may include age declarations, account controls, security signals, fraud detection, verification technologies, manual review, user reports, and additional verification where appropriate.

Where enabled, UnityMix may use the Face Liveness + Adult Age Check as one component of its age-assurance process.

UnityMix may request additional age or identity verification when reasonably necessary to protect Users, Creators, UnityMix, payment systems, or to satisfy applicable legal requirements.

6. Face Liveness + Adult Age Check

Purpose

The Face Liveness + Adult Age Check is designed to help reduce fraudulent or automated attempts to access an adults-only service.

• Helps determine whether a real person is present.
• Helps protect against photographs and static images.
• Helps protect against recorded or replayed video.
• May help detect virtual-camera or simulated camera input.
• May perform an approximate adult-age estimation after liveness verification.

Adult-Age Estimation

The adult-age check provides an approximate automated estimation. It is not a determination of a person's exact age, legal identity, date of birth, or identity-document information.

Results may be inaccurate because of lighting, camera quality, facial positioning, image quality, device limitations, or other technical factors.

Camera Processing

Where the applicable UnityMix implementation uses browser-based processing, camera video is processed within the user's browser during the verification process.

Verification-related results, technical signals, or other information necessary to operate the applicable verification service may be processed as described in the UnityMix Privacy Policy and applicable third-party provider disclosures.

7. Account Registration & Security

You agree to provide accurate, complete, and current information when creating and maintaining your account.

• Maintain accurate account information.
• Protect your password and authentication credentials.
• Keep account recovery information secure.
• Use reasonable security precautions.
• Notify UnityMix of suspected unauthorized access.
• Do not sell, rent, transfer, or share your account.

8. Creator Accounts & Monetization

Eligible Users may use UnityMix Creator tools to publish permitted content, communicate with subscribers, offer subscriptions, provide Paid Content, livestream, and participate in approved monetization programs.

Creators are responsible for their content, representations, transactions, services, promotions, and compliance with applicable laws and UnityMix policies.

9. User Content

Users retain ownership of content they lawfully own.

By submitting User Content to UnityMix, you grant UnityMix a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, display, distribute, transmit, adapt, and otherwise use that content as reasonably necessary to operate, secure, improve, promote, and provide the Services, subject to applicable law and the UnityMix Privacy Policy.

You represent and warrant that you own or have obtained all rights, permissions, licenses, and consents necessary to submit and use your content through UnityMix.

10. Content Safety, Nudity Protection & Automated Moderation

UnityMix may use automated technology, machine-assisted systems, human moderators, or a combination of these methods to identify and address content that violates UnityMix policies or applicable law.

UnityMix may automatically analyze uploaded photographs, images, videos, or other content for prohibited material, including certain forms of nudity or sexually explicit material that violate UnityMix's applicable content rules.

11. Prohibited Content & Conduct

• Sexual exploitation or abuse of minors.
• Child sexual abuse material or equivalent illegal material.
• Grooming or sexual solicitation of minors.
• Illegal or fraudulent activity.
• Threats, stalking, harassment, or targeted abuse.
• Hate-based threats or unlawful discriminatory conduct.
• Malware, phishing, malicious code, or harmful software.
• Impersonation intended to deceive or cause harm.
• Spam and automated abuse.
• Unauthorized access to accounts or systems.
• Attempts to bypass platform security.
• Manipulation of liveness, age-assurance, verification, moderation, or fraud systems.
• Fraudulent payment activity.
• Chargeback abuse.
• Content that violates applicable law.

12. Child Safety & Protection of Minors

UnityMix is strictly an adults-only service and does not permit individuals under the applicable minimum age to use the platform.

UnityMix maintains a strict prohibition against child sexual exploitation and abuse.

13. Children's Privacy & COPPA

UnityMix is an adults-only service and is not designed or intended for children.

UnityMix does not knowingly invite children under 13 to create accounts or use the Services.

If UnityMix obtains actual knowledge that an account belongs to a child under 13, UnityMix may take appropriate action consistent with applicable law, including restricting or terminating the account and addressing applicable personal information as required by law.

14. Safety Reporting

Users should promptly report suspected underage accounts, child exploitation, prohibited content, harassment, fraud, security abuse, or other serious violations through UnityMix's available reporting mechanisms.

15. Content Moderation & Safety Enforcement

UnityMix may review, moderate, restrict, remove, disable, demonetize, or otherwise take action concerning content or accounts that violate these Terms, applicable law, or UnityMix policies.

• Content removal.
• Content restriction.
• Warnings.
• Feature restrictions.
• Age or identity verification requests.
• Temporary suspension.
• Demonetization.
• Payout holds or review.
• Permanent account termination.

16. Verification, Security & Personal Information

UnityMix may process information associated with account security, fraud prevention, age assurance, liveness detection, approximate adult-age estimation, identity verification, content moderation, and platform safety as described in the applicable UnityMix Privacy Policy.

Users should review the UnityMix Privacy Policy and applicable third-party provider disclosures for information concerning processing, retention, security, and applicable privacy rights.

17. Third-Party Services

UnityMix may use third-party providers for payment processing, hosting, security, liveness detection, age or identity verification, content moderation, analytics, communications, fraud prevention, authentication, and other platform functions.

18. Subscriptions & Recurring Billing

UnityMix may offer recurring or fixed-term subscriptions providing access to Creator content, features, services, or other benefits.

Unless otherwise stated at purchase, recurring subscriptions may automatically renew until canceled.

Cancellation generally prevents future renewals but does not necessarily create a refund for previously charged amounts or unused portions of a billing period, except where required by applicable law or expressly provided by UnityMix.

19. Paid Content, Messaging, Calls & Services

UnityMix may permit eligible Creators to offer Paid Content, paid messages, paid chats, audio calls, video calls, subscriptions, livestream access, and other paid services.

20. Creator Earnings & Payouts

Creators may receive earnings from eligible transactions subject to applicable payout terms, fees, thresholds, schedules, account requirements, and payment-provider requirements.

UnityMix may delay, hold, reverse, adjust, or withhold payouts when reasonably necessary to investigate fraud, chargebacks, disputes, policy violations, unlawful activity, or suspicious transactions.

21. Refunds, Chargebacks & Payment Disputes

Refund eligibility depends on the applicable purchase, subscription, service, transaction, refund policy, and applicable law.

Fraudulent chargebacks, payment abuse, unauthorized transactions, or attempts to obtain Services without valid payment may result in account restriction, suspension, termination, or recovery of amounts owed to the extent permitted by law.

22. Marketplace Transactions

UnityMix may provide marketplace functionality allowing eligible Users, Creators, businesses, or sellers to offer permitted products or services.

Sellers are responsible for the legality, accuracy, pricing, quality, fulfillment, taxes, delivery, and applicable customer obligations associated with their offerings.

23. Promotions, Giveaways & Referral Programs

Promotions, contests, giveaways, referral programs, and similar activities may be subject to additional terms and eligibility requirements.

24. Intellectual Property

UnityMix's names, trademarks, logos, designs, interfaces, software, features, databases, technology, and other proprietary materials are owned by UnityMix, Inc. or applicable licensors and are protected by applicable intellectual property laws.

25. Copyright & DMCA

UnityMix respects intellectual property rights and expects Users to do the same.

Copyright owners may submit infringement notices containing the information required under applicable law.

26. User Conduct

• No harassment, stalking, or abuse.
• No impersonation intended to deceive.
• No illegal activity.
• No unauthorized system access.
• No security exploitation.
• No fraudulent activity.
• No payment manipulation.
• No automated abuse or bot activity.
• No bypassing verification or safety systems.
• No interference with platform operations.

27. Suspension & Termination

UnityMix may restrict, suspend, or terminate accounts when reasonably necessary to protect Users, UnityMix, payment systems, the platform, third parties, or comply with applicable law.

Termination does not eliminate obligations or liabilities that arose before termination.

28. Privacy

UnityMix's collection, use, processing, storage, disclosure, and protection of personal information are governed by the applicable UnityMix Privacy Policy.

29. Safety Technology Limitations

UnityMix uses reasonable technical, administrative, automated, and human safeguards to help protect the platform and its Users.

No online platform, age-assurance system, automated moderation system, fraud detection system, security system, or human review process can guarantee detection or prevention of every violation, false identity, bot, minor, fraudulent transaction, prohibited image, or security threat.

30. Disclaimers & Limitation of Liability

To the maximum extent permitted by applicable law, the Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties except where expressly provided by law.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

31. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless UnityMix, Inc., its affiliates, officers, directors, employees, agents, contractors, and service providers from claims, liabilities, damages, losses, costs, and expenses arising from or relating to your violation of these Terms, your User Content, your unlawful conduct, or your misuse of the Services.

32. Dispute Resolution & Governing Law

To the extent permitted by applicable law, disputes arising from or relating to the Services or these Terms may be subject to binding arbitration and applicable limitations on class or representative proceedings.

Governing law: the laws of the State of New York, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.

33. Changes to These Terms

UnityMix may update these Terms from time to time to reflect changes in Services, technology, security practices, business operations, legal requirements, or other circumstances.

Your continued use of UnityMix after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

34. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by applicable law.

35. Entire Agreement

These Terms, together with the applicable UnityMix Privacy Policy, Age Assurance & Verification Policy, Child Safety Policy, Content & Nudity Protection Policy, Community Guidelines, Creator Terms, payment policies, and other policies expressly incorporated by reference, constitute the agreement governing your use of the Services, except where a separate written agreement expressly applies.
